These Terms & Conditions ("Terms") govern your use of the Pit Pals website and your purchase of Pit Pals products, including trading cards, packs, boxes, collectibles and related merchandise ("Products").

By accessing our website or purchasing a Product, you agree to be bound by these Terms.

1. ABOUT PIT PALS

Pit Pals is an independent collectable trading card brand operated by PIT PALS PTY LTD ("Pit Pals", "we", "us" or "our").

Pit Pals is a fan-created collectable art project and is not affiliated with, endorsed by, sponsored by, or officially connected with any racing organisation, team, driver, sponsor, manufacturer, or other third party.

2. ORDERS AND PURCHASES

By placing an order, you confirm that:

• The information you provide is accurate and complete.

• You are authorised to use the payment method provided.

• You have reviewed your order before completing your purchase.

An order is not considered accepted until payment has been successfully received and the order has been confirmed by us.

We reserve the right to refuse, cancel or limit an order where reasonably necessary, including in circumstances involving pricing errors, suspected fraud, stock errors, purchasing abuse or other exceptional circumstances.

If we cancel an order after payment has been received, you will be entitled to a refund of the amount paid for the cancelled Product.

3. PRODUCT AVAILABILITY

All Products are subject to availability.

Limited-edition Products, special cards, inserts, autographs, redemptions, numbered cards and other chase cards may have limited quantities and may sell out without notice.

Product images are provided for illustrative purposes. Due to the nature of manufacturing and printing, minor variations in colour, alignment, finish or appearance may occur.

4. TRADING CARD PACKS AND RANDOMISED PRODUCTS

Pit Pals trading card Products may contain randomly distributed cards, including base cards, parallels, inserts, special cards and other limited-edition cards.

Unless expressly stated otherwise, purchasing additional packs does not guarantee that you will receive a complete set or any particular card.

Published odds, print runs and card quantities may be stated on the Product packaging, website or promotional materials where applicable. Where stated, these figures are intended to describe the distribution of the relevant Product and are not a guarantee that an individual purchaser will receive a particular card.

5. REDEMPTIONS

Certain Pit Pals Products may contain redemption cards or redemption codes.

Where a redemption is offered:

• The redemption is subject to the specific terms stated on the redemption card or accompanying instructions.

• Redemption claims must be submitted using the method specified by Pit Pals.

• A redemption may be limited to a specified number of successful claims.

• Redemptions may be subject to an expiry date where stated.

• Redemption cards do not guarantee that a particular person, autograph, item or experience will be available unless expressly stated.

• Once the stated redemption allocation has been claimed, further claims may not be fulfilled.

Where a redemption relates to an item that is delayed, unavailable or otherwise cannot reasonably be supplied, Pit Pals may provide an alternative of equal or comparable value where reasonably appropriate.

Nothing in this section limits any rights you may have under applicable Australian Consumer Law.

6. AUTOGRAPHS AND SPECIAL CARDS

Where Products contain autograph, signature-style, artwork, novelty or otherwise non-standard cards, the nature of the card will be described in the relevant Product information.

Some cards may feature stylised, novelty or artist-created signatures and should not be assumed to be an official autograph unless expressly identified as such.

7. SHIPPING AND DELIVERY

We ship Products to the destinations made available at checkout.

Estimated delivery times are provided as a guide only and are not guaranteed unless expressly stated otherwise.

Once an order has been dispatched, responsibility for delays caused by postal services, customs authorities, natural events, incorrect address information or other circumstances outside our reasonable control may not be attributable to Pit Pals.

You are responsible for providing a complete and accurate delivery address.

If an order is returned to us because an incorrect or incomplete address was provided, additional shipping costs may apply before the order can be resent.

8. INTERNATIONAL ORDERS, DUTIES AND TAXES

International customers may be required to pay customs duties, taxes, import fees, brokerage fees or other charges imposed by the destination country.

Unless expressly stated otherwise at checkout or in the applicable shipping policy, these charges are the responsibility of the customer.

Pit Pals has no control over customs charges imposed by another country and cannot guarantee the amount of any applicable import fees.

Customers are responsible for ensuring that Products can legally be imported into their destination country.

9. RETURNS, REFUNDS AND FAULTY PRODUCTS

We want you to receive your Products in the condition in which they were intended to be supplied.

If you receive a Product that is faulty, damaged or materially different from what you ordered, please contact us as soon as reasonably possible with your order details and relevant photographs or other evidence.

Where required under Australian Consumer Law, we will provide an appropriate remedy, which may include a repair, replacement or refund.

All sales are final unless damaged/faulty and changes of mind returns will not be accepted unless required by law.

We are not responsible for damage caused after delivery by misuse, improper storage, accidents or other circumstances outside our reasonable control.

10. PRE-ORDERS

Where a Product is offered as a pre-order, the estimated release or shipping date will be communicated at the time of purchase where reasonably possible.

Release dates are estimates and may change due to manufacturing, production, shipping or other circumstances.

If a significant delay occurs, we will provide an update and, where required by law, provide an appropriate remedy.

11. PRICING AND PAYMENT

All prices displayed on our website are in Australian dollars unless otherwise stated.

We reserve the right to change prices, Product availability and promotional offers at any time before an order is accepted.

If a Product is accidentally listed at an incorrect price due to a technical or administrative error, we may cancel the affected order and provide a refund of any amount paid.

12. PROMOTIONS AND DISCOUNTS

Promotional offers, discounts and giveaways may be subject to additional terms.

Unless otherwise stated, promotions cannot be combined with other offers.

We reserve the right to withdraw or modify a promotion where reasonably necessary, subject to applicable law.

13. INTELLECTUAL PROPERTY

All Pit Pals branding, artwork, illustrations, logos, designs, Product names, website content, graphics, text and other original materials are owned by or licensed to Pit Pals unless otherwise stated.

You may not reproduce, distribute, modify, sell, commercially exploit or otherwise use Pit Pals intellectual property without our prior written permission.

Purchasing a Product does not transfer ownership of any underlying intellectual property rights.

You may display or photograph Products that you legitimately own for personal, collection, review or social media purposes, provided that such use does not falsely imply endorsement, sponsorship or official affiliation.

14. USER CONTENT

If you submit photographs, videos, reviews, comments or other content relating to Pit Pals ("User Content"), you retain ownership of your content.

By submitting User Content to us or publicly tagging Pit Pals in connection with your Product, you grant Pit Pals a non-exclusive, worldwide, royalty-free licence to repost, display and promote that content in connection with Pit Pals, including on our website and social media channels.

You should only submit content that you have the right to share.

15. WEBSITE USE

You agree not to:

• Use the website for unlawful purposes.

• Attempt to interfere with or compromise the website or its security.

• Use automated systems to purchase Products in a manner that circumvents reasonable purchase limits.

• Scrape, copy or reproduce substantial portions of the website or its content without permission.

• Submit false, misleading or fraudulent information.

• Attempt to obtain Products through unauthorised means.

We may restrict or terminate access to the website where reasonably necessary to protect our business, customers or website.

16. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Pit Pals will not be responsible for indirect, incidental or consequential losses arising from the use of our website or Products.

Nothing in these Terms excludes, restricts or modifies any right, remedy, guarantee, warranty or condition that cannot lawfully be excluded under applicable law, including rights under the Australian Consumer Law.

To the extent permitted by law, our liability for a Product will be limited to the remedies available under applicable consumer law and, where legally permitted, the replacement, repair or refund of the relevant Product.

17. EVENTS OUTSIDE OUR CONTROL

We are not responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, pandemics, industrial disputes, postal disruptions, customs delays, government actions, manufacturing interruptions, supplier failures or major technical failures.

Where reasonably possible, we will notify affected customers of significant disruptions.

18. PRIVACY

Personal information provided to Pit Pals will be handled in accordance with our Privacy Policy.

We may collect information necessary to process orders, provide customer support, deliver Products, prevent fraud and operate our website.

We will not sell your personal information to third parties except where permitted by law or otherwise disclosed in our Privacy Policy.

19. CHANGES TO THESE TERMS

We may update these Terms from time to time.

The version published on our website will apply to purchases made after the relevant update, unless otherwise required by law.

The Terms applicable at the time you placed an order will generally govern that purchase.

20. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down or removed to the extent necessary, without affecting the validity of the remaining provisions.

21. GOVERNING LAW

These Terms are governed by the laws of Western Australia, Australia.

Any disputes will be subject to the applicable courts and tribunals of Western Australia, subject to any mandatory rights you may have under applicable law.
